জমি ও আন্যান্য সম্পত্তি হস্তান্তরের দলিল ও রেজিস্ট্রেশনের নিয়ম

ভূমি ও অন্যান্য সম্পত্তি রেজিস্ট্রেশন বিষয়ক বিভিন্ন তথ্য দলিলের ছক বা ফরমেট:

  • ভূমি হস্তান্তরের দলিল স্ট্যাম্পের উপর সরকার কর্তৃক প্রকাশিত নির্দিষ্ট ফরমেট বা ছক অনুযায়ী তৈরি করতে হবে। এই ছকে ক্রেতা-বিক্রেতার ছবি সংযোজনের নতুন বিধান রাখা হয়েছে।
তামাদি হওয়ার সময় সীমা
  • তামাদি হোয়ার সময়-সীমা তিন বছর থেকে এক বছর করা হয়েছে। দলিল তৈরী হওয়ার তিন মাসের মধ্যে তা রেজিস্ট্রেশন করতে হবে।
দলিল রেজিস্ট্রেশনের সময়
  • দলিল তৈরী হওয়ার তিন মাসের মধ্যে তা রেজিস্ট্রেশন করতে হবে। মৌখিক দান বা হেবা দলিল রেজিস্ট্রেশন।
  • মুসলিম পারিবারিক ধর্মীয় আইন অনুযায়ী স্তাবর সম্পত্তি মৌখিক দান বা হেবা দলিলো এখন থেকে রেজিস্ট্রেশন করতে হবে। এই দলিল হবে ঘোষণামূলক। এর জন্য ফি হবে মাত্র ১০০=(একশত) টাকা।
হেবা বা দান কে কাকে করতে পারে:-
  • হেবার ক্ষেত্রে শুধু রক্ত সম্পর্কিত আত্মীয় তথা স্বামী ও স্ত্রীর মধ্যে, পিতা-মাতা ও সন্তানের মধ্যে, ভাই-ভাই, বোন-বোন অথবা ভাই-বোন, দাদা-দাদী, নানা-নানী থেকে নাতি-নাতনী ও নাতি-নাতনী থেকে নানা-নানী সম্পর্কের মধ্যে হেবা দলিলে রেজিস্ট্রেশনের ক্ষেত্রে এই নাম মাত্র ১০০ (একশত) টাকা ফিতে রেজিস্ট্রেশনের সুযোগ পাওয়া যাবে।
উত্তরাধিকার সূত্রে পাওয়া সম্পত্তির রেজিস্ট্রেশন:-
  • উত্তরাধিকার সূত্রে পাওয়া সম্পত্তি রেজিস্ট্রেশন করা বাধ্যতামূলক। তবে এক্ষেত্রে ওয়ারিশগণের মধ্যে সম্পত্তি বন্টন না হওয়া পর্যন্ত রেজিস্টেশন করার প্রয়োজন নেই।

সম্পত্তি বন্ধকের ক্ষেত্রে রেজিস্ট্রেশন:-
  • সম্পত্তি বন্ধকের ক্ষেত্রেও রেজিস্ট্রেশন বাধ্যতামূলক করা হয়েছে। এক্ষেত্রে রেজিস্ট্রেশন ফি হবে ২০০ (দুইশত) টাকা থেকে ৫০০০(পাঁচ হাজার) টাকা। আগে যা ছিল ৫০০(পাঁচশত) টাকা থেকে ৫০,০০০(পঞ্চাশ হাজার) টাকা। এর ফলে বন্ধকি সম্পত্তি কেহ অন্যত্র বিক্রয় করে প্রতারণা বা জালিয়াতির আর কোন সুযোগ পাবে না।

আদালতের মাধ্যমে প্রাপ্ত অগ্রক্রয় সম্পত্তির রেজিস্ট্রেশন:-

  • আদালতের মাধ্যমে প্রাপ্ত অগ্র ক্রয় দলিলও রেজিস্ট্রেশন বাধ্যতামূলক করা হয়েছে।
বায়না চুক্তির রেজিস্ট্রেশন ও ফি:-
এখন থেকে বায়না চুক্তি রেজিস্ট্রেশন করতে হবে। সম্পত্তি বিক্রয়ের জন্য বায়নার ক্ষেত্রে ৫(পাঁচ) লক্ষ টাকা পর্যন্ত সম্পত্তির ক্ষেত্রে ৫০০/-(পাঁচশত) টাকা এবং ৫ লক্ষ টাকার অধিক থেকে ৫০ লক্ষ টাকা পর্যন্ত ১,০০০/-(এক হাজার) টাকা। ৫০ লক্ষ টাকার অধিকমূল্য সম্পত্তির জন্য ২,০০০/-(দুই হাজার) টাকা রেজিস্ট্রেশন ফি দিতে হবে। বায়না নামা রেজিস্ট্রেশন করা ছাড়া চুক্তি বলবৎ করতে আইনগত কোন সুবিধা পাওয়া যাবে না। আবার বায়নার অবশিষ্ট টাকা জমা না করা হলে কোন মামলা মোকদ্দমা করা যাবে না। সম্পত্তি বিক্রয়ের বায়নানামা চুক্তির ৩০ দিনের মধ্যে রেজিস্ট্রেশন করতে হবে ১লা জুলাই ২০০৫ থেকে এ আইন কার্যকর হওয়ার আগে যেসব বায়না হয়েছে কিন্তু এখনও রেজিস্ট্রেশন হয় নাই সেগুলো ১ জানুয়ারি ২০০৬ এর মধ্যে রেজিস্ট্রেশন করতে হবে। আবার বায়নানামা রেজিস্ট্রেশন না করা এসব চুক্তি কার্যকর বা বাতিল করতে হলে রেজিস্ট্রশনের জন্য নির্দিষ্ট মেয়াদের পর ৬ মাসের মধ্যে মামলা করতে হবে। সম্পত্তি হস্তান্তরের দলিল ৩ মাসের মধ্যে রেজিস্ট্রেশন করতে হবে।
বিঃ দ্রঃ ভবিষ্যতে মামলা মোকদ্দমা থেকে পরিবারগুলোকে রক্ষা করতে উত্তরাধিকার সূত্রে প্রাপ্ত সম্পত্তির দলিল রেজিস্ট্রেশন করা বাধ্যতামূলক করা হয়েছে। পূর্বে পুরুষদের আপসে সম্পত্তি বন্টনের দলিল রেজিস্ট্রেশন বার্ধমূলক করার ফলে ওয়ারিশদের ভোগান্তি অনেকাংশে হ্রাস পাবে। মাত্র ২০-(বিশ) টাকা মূল্যের স্ট্রাম্পে দলিল করে তা রেজিস্ট্রেশন করা যাবে এবং সর্বোচ্চ অংশ প্রাপ্ত অংশীদারের সম্পত্তির হিসাব থেকে বাদ দিয়ে অপেক্ষাকৃত কম পরিমাণের অংশীদারদের ভগে পাওয়া সম্পত্তির মূল্য মানের শতকরা আড়াই ভাগ টাকা সব অংশীদারের কাছ থেকে রেজিস্ট্রেশন ফি বাবদ নেওয়া হবে।

জমি ক্রয়-বিক্রয় সতর্কতা অবলম্বনের জন্য কয়েকটি প্রয়োজনীয় পরামর্শ

কথায় আছে “পয়সা দিয়ে ঝগড়া-ফ্যাসাদ কিনতে চায় কে?” তাই ভূমি ক্রয়ের সময় সম্ভাব্য সকল যুক্তিসঙ্গত সতর্কতা অবলম্বন ও অনুসন্ধানের প্রয়োজন রয়েছে। 

জমি ক্রয়ের পূর্বে ক্রেতাকে যে প্রধান বিষয়গুলোর প্রতি সতর্ক হতে হবে তা হলো:
 

কেবল ভূমির মালিকই তার ভূমি যে কোন ভাবে হস্তান্তর করতে পারেন। তাই হস্তান্তরকারীর মালিকানা ও দখলীয় স্বত্ব এবং অন্যান্য গুরুত্বপূর্ণ বিষয়গুলো বৈধ কাগজ পত্র স্বাপেক্ষে ভাল করে দেখার প্রয়োজন।

১. বিক্রিত ভূমির সংশ্লিষ্ট খতিয়ানে বিক্রেতার নাম আছে কিনা?



২. যদি বিক্রেতার নাম খতিয়ানে না থাকে তবে ভূমিতে বিক্রতার স্বত্ব বৈধ কাগজপত্র দ্বারা প্রমাণ করতে হবে।


৩. বিক্রির ভূমি (১) কোন মৌজায় অবস্থিত, (২) কোন খতিয়ান ও (৩) কোন দাগভুক্ত (৮) ইহার পরিমাণ এবং (৫) উক্ত খতিয়ানে ভূমিতে বিক্রতার অঙশ বা হিস্যা অনুয়ায়ী পরিমাণ ইত্যাদি ক্রয়ের পূর্বে কাগজ পত্র দ্বারা ভালভবে যাচাই করে দেখতে হবে।
ক্রয় দলিল দৃষ্টে ভূমি ক্রয় করতে হলে দেখতে হবে:
(ক) দলিলে উল্লেখিত (১) দলিলদাতা বা দাতাদের নাম ও (২) ভূমির বিবরন ও পরিমাণ সংশ্লিষ্ট খতিয়ানে লেখনভুক্ত রয়েছে কিনা, যদি তার বা তাদের নাম সংশ্লিষ্ট খতিয়ানে লেখনভুক্ত না হয়ে থাকে হবে খতিয়ানে লেখনভুক্ত মলিকের চাছ হতে বকভাবে তারা পেয়েছেন তা অবশ্যই কাগজ পত্রের মাধ্যমে দেখাতে হবে।
এরুপ খতিয়ানে লেখনভুক্ত মালিক কর্তৃক বিক্রি হবার পর উক্ত ভূমি যতবার বিক্রি হয়েছে এবং ইহার দরুন যতটি দলিল সমআদিত হয়েছে ততটি দলিল (পিট দলিল বা ধারাবাহিক দলিল) পরীক্ষা করে দেখতে হবে।
অন্য কোন ব্যতিক্রম না থাকলে কেবলমাত্র সংশ্লিষ্ট খতিয়ানভুক্ত মালিক বা তাঁর মৃত্যুর পর তাঁর উত্তরাধিকারীগণ ভূমি হস্তান্তর করতে পারেন। সুতরাং বিক্র বা মালিকানা স্বত্ব অর্জনের ধারাবাহিকতা অবশ্যই দেখতে হবে।
(খ) হাল খতিয়ান ও হাল দাগ চালু হওয়ার পূর্বেকার সমআদিত দলিলে উল্লেখিত খতিয়ান ও দাগ নম্বর, সাবেক দাগ ও খতিয়ানে নম্বরে পরিণত হয়েছে।
সুতরাং দলিলে উল্লেখিত খতিয়ান, দাগ যাহা সাবেক খতিয়ান ও দাগ নম্বরে পরিণত হয়েছে ইহার সাথে বর্তমান চালু (হাল) খতিয়ান, দাঘ ও জমির পরিমাণের মিল আছে কিনা তা পরীক্ষা করতে হবে।
(গ) বিক্রির পর ক্রেতার নামজারী না হওয়ার বিংবা ক্রেতা নাম জারী না করার দরুন এই সুযোগে বিক্রতা প্রতারণামূলক অন্যের বা ২/৩ জনের কাছে গোপনে বিক্রি করে থাকতে পারে। সুতরাং ক্রয়ের পূর্বে এই বিষয়টি বিবেচনা করতে হবে এবং অনুসন্ধান করতে হবে। এরুপ ঘটনা কখনো কখনো ঘটে থাকে।
(ঘ) বিক্রিত ভূমি বিক্রতার দখলে আছে কিনা তাও দেখতে হবে।
(ঙ) বকেয়া ভূমির খাজনা বা ভূমি উন্নয়ন করের জন্য ভূমি নিলামে বিক্রি হয়েছে কিনা অথবা নিলামে সরকার ক্রয় করে খাস করেছন কিনা তাও দেখতে হবে।
(চ) যে সকল হিন্দু নাগরিক তাদের জমি-জমা পরিত্যাগ করে বাস্ত্ত ত্যাগ করে ভারতে চলে গেছেন এবং সেখানে নাগরিকত্ব লাভ করে বসবাস করেছেন তাদের অনেকের ভূমির অর্পিত ও অনাবাসী সম্পত্তি হসাবে তালিকাভূক্ত হয়েছে এগুলো সরকারের তত্ত্বাবধানে রয়েছে।
সুতরাং এরুপ হিন্দু মালিকদের ভূমি পরির্তক্ত হওয়ার দরনি কাস বা অর্পিত ও অনাবাসী সম্পত্তি হিসাবে তালিকাভূক্ত হয়েছে কিনা তাও দেখতে হবে।
(জ) যে সকল মালিক ১৯৭১ সনের স্বাধীনতা-যুদ্ধে বিরোধীতা করেছিল এবং তাদের ভূমি ও বাড়ী-ঘর ত্যাগ করে বাংলাদেশ হতে চলে গিয়েছিল তাদের ভূমি পি-ও ১৬/৭২ বলে পবরত্যাক্ত ভুমি হিসাবে ঘোষণা করা হয় এবং ঐ জমি সরকারের নিয়ন্ত্রাধীন হয়।
এই শ্রেণীর মালিকদের ভূমি ক্রয়ের ক্ষেত্রে অনুসন্ধান করে দেখতে হবে।
(ঝ) যে সকল ভূমির খাজনা বা ভূমি উন্নয়ন কর দীর্ঘদিন যাবৎ অনাদায় রয়েছে অথবা মারফতদার কর্তৃক খাজনা বা কর পরিশোধ হয় তহশীল অফিসে ইহার কারণ অনুসন্ধান করলে ভূমির প্রকৃত স্বত্বাধিকারী এবং ইহার অবস্থা কি তা সহজেই জানা যাবে।
(ঞ) তাছাড়া ভূমির খাজনা বা উন্নয়ন কর অপরিশোধিত থাকলে নিলামে খাস হওয়ার সন্দেহের অবকাশ থাকে। সুতরাং তহশীলে খোঁজ নিয়ে দেখা যেতে পারে।
(ট) টেস্ট একুইজিশন এন্দ টেন্যান্সস এ্যাক্টের ৯৭ ধারা অনুযায়ী কোন আদিবাসীর ভূমি অনুরুপ আদিবাসী ব্যতিত কেহ ক্রয় করতে চাইলে বা অন্যের নিকট হস্তান্তর করতে চাইলে দলিলে রেজিস্ট্রি করার পূর্বে রেভিনিউ অফিসারের লিখিত সম্মতি লইতে হবে যাহা দলিলে উল্লেখ করতে হবে। এই বিধান লংধন করলে ভূমি ক্রয় বা হস্তান্তর বাতিল হয়ে যাবে। 
(ঠ) প্রেসিডেন্ট আদেশ নং ৯৮/৭২ অনুযায়ী, ১৩-৪-৮৪ তারিখ পর্যন্ত কোন পরিবার ১০০ বিঘার অতিরিক্ত ভূমি এবং (অধ্যাদেশ ১০/৮৪) ভূমি সংস্কার অধ্যাদেশ-১৯৮৪ এর ৪ ধারা অনুযায়ী যে সকল মালিক বা পরিবারের ৬০ বিঘার নিন্মে অথবা ৬০ বিঘা পর্যন্ত ভূমি ছিল তারা উক্ত অধ্যাদেশ জারীর তারিখ হতে (অধ্যদেশ ১০/৮৪ জারীর তারিখ ১৪-৪-৮৪ ইং, বাংলা ১লা বৈশাখ ১৩৯১) ৬০ বিধার অতিরিক্ত ভুমি ক্রয় বা অন্যবিধ উপায়ে অর্জন করতে পারবেন না।
উক্ত আদেশ ো অধ্যাদেশ লংঘন করে যদি কোন মালিক বা পরিবার উপরোক্ত সীমার অতিরিক্ত ভূমি ক্রয় করেন তাহলে এরুপ অতিরিক্ত ভূমি সরকারের বরাবরে বাজেয়াপ্ত হয়ে যাবে। 
(ড) দলিলে খতিয়ানের মালিকদের নাম ভায়া দলিল থাকলে উহার নম্বর দাতা গ্রহীতা ইত্যাদির বৃত্তান্ত দলিলে উল্লেখ্য থাকা একান্ত আবশ্যক।
(ঢ) দলিলের তফসীলে জেলা, থানা, মৌজা, খতিয়ান, দাগ, ভূমির মোট পরিমাণ এবঙ কাত যদি থাকে এবং চৌহদ্দি শহরের ভূমি হলে রাস্তা পৌর নম্বর থাকলে উহা সহ্য তদস্থিত দালান-কোঠা যদি থাকে হবে সঠিকভাবে উল্লেখ করা একান্ত প্রয়োজন।

Foreign exchange: Foreign exchange means the money of the other country i.e foreign currency bank balance, bank notes, checks and drafts.
A foreign exchange transaction is an agreement between a buyer and a seller that a given amount of currency is to be delivered at a specified rate for some other currency.


Functional Currency: The Functional currency is the currency of the primary economic environment in which the entity operates.
 


Foreign currency: Foreign currency is any currency not normally used in a particular region or country. A foreign currency is any currency other than the reporting currency. The functional currency could be either the reporting currency or the foreign local currency.


Direct rate: A direct rate is a home currency price of a unit of foreign currency. An example- a direct rate between the US dollar and the Bangladesh Tk. Where the Bangladesh is designed as the home country. Using united states and the Bangladesh (home country) is-

Current- Noncurrent Method: Under the current no current method, as shown in exhibit current assets and liabilities are translated at current exchange rates and noncurrent assets and liabilities and stock holders equity are translated at historical exchange rates. This method was generally accepted in the US from the early 1930 until FASB statement and was issued in October 1975.

Temporal method: The temporal method was originally proposed in accounting research study. According to the temporal method cash receivables and paybles are translated at the current rate. Other assets and liabilities may be translated at current or historical rates, depending on their characteristics.

The role of stock market in Bangladesh economy


The size of the world stock market or equity market is more than US$55 trillion and the total derivatives market has been estimated at about $850 trillion at the end of December 2010, 12 times the size of the world economy. The enormous size of the value of stock market simply justifies the economic magnitude and diversity of the stock market. The stock market has been playing a very significant role in the economy of a country since the 12th century and has flourished the global economy in the 21st century. Virtually every developed, developing and underdeveloped economy has stock markets handling billions of dollars, trading of stocks of listed companies throughout every business day. The world's largest stock markets are in the United States, United Kingdom, Japan, India, China, Germany, France, South Korea and the Netherlands. The stock market is one of the most important sources for companies to raise money as "share capital" from individuals and institutions. This allows businesses to be publicly traded, or raise additional financial capital for balancing, modernising, reconstruction or expansion (BMRE) by selling shares of ownership of the company in a public market. This is an attractive feature of investing in stocks, compared to other, less liquid investments such as real estate. Some companies actively increase liquidity by trading in their own shares. A stock market provides a central location for investors to come together to buy and sell shares in companies. These transactions take place for listed companies that have to make public announcements of profit, loss and revenue figures. The individuals who own shares of these companies are its shareholders and they are entitled to a yearly dividend set by the company. The stock market has two main segments - the primary market and the secondary market. New issues of shares in a company, or initial public offerings (IPOs), are dealt with in the primary market, while existing shares can be bought or sold in the secondary market. Most of the daily trading volume comes from the secondary market. A stable stock market indicates healthy trading activity and strength in the country's economy. Rising prices of stocks and other securities are indicators or predictors to the level of economic growth. The performance of the stock market can also be seen as a barometer of public sentiment, and conversely, the general perception of investors about the economy can also influence the stock market significantly. A fall in stock prices indicates pessimism among investors and an expectation of subdued industrial activity in the near future. Any uncertainty in the country, like an impending change or deviation in the policy and strategy of the government, central bank and other statutory bodies, political instability, can also subdue prices in the stock market. In fact, the stock market is often considered the primary indicator of a country's economic strength and development. Rising share prices, for instance, tend to be associated with increased business investment and vice-versa. Share prices also affect the wealth of households and their consumption. Therefore, central banks tend to keep an eye on the control and behaviour of the stock market and, in general, on the smooth operation of financial system functions. Financial stability is the ultimate aim of all central banks. The economy can benefit stupendously from a stock market that is properly regulated, transparent, and allows investors to conveniently buy and sell stocks to earn returns. A stock exchange market fulfils two primary purposes: (a) it encourages public participation in private business ventures. Entrepreneurs with good business ideas can raise huge amounts of capital by launching a public issue of the company's shares in the primary market; (b) through the stock market investors get the opportunity to share the success of large institutions that have the expertise to do well in their ventures. This is a universally acceptable unique and economically viable system that paves the way for investing the idle money and small to medium size savings of the mass people in the manufacturing or commercial companies; thus provides goods and services and employment to the economy.

The stock market is supposed to ensure through the takeover mechanism that past investments are also most efficiently used. Theoretically, the threat of takeover is expected to provide management with an incentive to maximise firm value. The presumption is that, if management does not maximise firm value, another economic agent may take control of the firm, replace management and reap the gains from the more efficient firm. Thus, a free market in corporate control, by providing financial discipline, is expected to provide the best guarantee of efficiency in the use of assets. Similarly, the ability to effect changes in the management of listed companies is expected to ensure that managerial resources are used efficiently. Efficient stock markets may reduce the costs of information. They may do so through the generation and dissemination of firm specific information that efficient stock prices reveal. Stock markets are efficient if prices incorporate all available information. Reducing the costs of acquiring information is expected to facilitate and improve the acquisition of information about investment opportunities and thereby improves resource allocation. Stock prices determined in exchanges and other publicly available information may help investor make better investment decisions and thereby ensure better allocation of funds among companies and as a result a higher rate of economic growth takes place.

Accounting

Accounting is an information science used to collect, classify, and manipulate financial data for organizations and individuals. 

Accounting is the recording of financial transactions plus storing, sorting, retrieving, summarizing, and presenting the information in various reports and analyses. Accounting is also a profession consisting of individuals having the formal education to carry out these tasks.


Cost Accounting

Cost Accounting is a phase of general accounting procedure by means of which details of cost of material, labor and overhead necessary to produce and sales of a article are recorded, summarized, analyzed and interpreted.
